By downloading, installing, or using the Apex app, you agree to be bound by these Terms of Use. If you do not agree with these terms, do not use the app.

2. Description of Service

Apex is a mobile fitness application that allows users to track workouts, log gym check-ins, monitor step counts, build streaks, and set weekly fitness goals. The app integrates with Apple Health (iOS) and Google Health Connect (Android), and uses location services to enhance the user experience. The app also includes social features allowing users to connect with friends and view each other's fitness progress.

3. Age Requirement

You must be at least 13 years old to use Apex. By creating an account, you represent that you meet this age requirement.

4. User Accounts

• You must create an account to use Apex. You are responsible for maintaining the security of your account credentials.
• You must provide accurate and complete information during registration.
• You are responsible for all activity that occurs under your account.

5. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the app or its systems.
• Interfere with or disrupt the app's functionality or infrastructure.
• Reverse-engineer, decompile, or disassemble any part of the app.

6. User Content & Social Conduct

You retain ownership of any content you create within the app, including workout names, notes, and profile pictures. By submitting content, you grant Apex a non-exclusive, royalty-free license to store and display this content as part of the service.

When using social features, you agree not to harass, impersonate, or abuse other users. Apex reserves the right to remove content or restrict accounts that violate these guidelines.

7. Health Disclaimer

Apex is a fitness tracking tool and does not provide medical advice. The app is not a substitute for professional medical guidance. Always consult a healthcare professional before beginning any exercise program. We are not liable for any injuries or health issues resulting from exercise activities tracked through the app.

8. Third-Party Services

Apex relies on third-party services including Clerk (authentication), Supabase (database), Google APIs (gym search and maps), and Expo (notifications). Your use of Apex is also subject to the terms and policies of these providers.

9. Intellectual Property

All content, features, and functionality of Apex — including but not limited to text, graphics, logos, and software — are owned by Apex and are protected by copyright, trademark, and other intellectual property laws.

Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for your personal, non-commercial fitness tracking purposes. This license does not transfer any ownership rights to you and may be revoked at any time if you violate these Terms.

10. Limitation of Liability

Apex is provided “as is” without warranties of any kind. We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app. Our total liability shall not exceed the amount you paid for the app in the preceding twelve months.

11. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms of Use. Upon termination, your right to use the app ceases immediately. To request deletion of your account and associated data, contact us at the.apexfitnessapp@gmail.com. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms of Use from time to time. Continued use of the app after changes constitutes acceptance of the updated terms. We will notify users of significant changes through the app.
